Merchant Terms of Use

These Merchant Terms of Use ("Terms") govern your participation as a restaurant or business (“Merchant”) on the Chibaobao platform, operated by Chibaobao Technology Sdn Bhd. By joining our platform, you agree to comply with these Terms.

1. Merchant Eligibility

• You must be a legally registered business or authorized representative.
• You must provide accurate and verifiable business documents.
• Your food must comply with Malaysian health and safety standards.

2. Platform Usage

• You may receive, accept, and manage customer orders through the Merchant App.
• You must not misuse or interfere with the platform.
• Unauthorized access, fraud, or manipulation of orders is strictly prohibited.

3. Merchant Responsibilities

• Maintain updated menu, pricing, operating hours, and availability.
• Prepare orders accurately and on time.
• Ensure food hygiene, quality, and safe packaging.
• Handle customer complaints professionally.

4. Fees and Payment

• Chibaobao does not charge commission but may apply a service margin to the Merchant’s original menu prices. The service margin may vary between merchants and will be reflected in the final price shown to customers.
• Weekly payouts will be made every Monday to the Merchant’s bank account.
• Chargebacks, refunds, or adjustments may be deducted where applicable.

5. Branding and Content

• You authorize Chibaobao to display your logo, menu, images, and branding.
• You must ensure all content is legal and does not violate copyright.

6. Data and Privacy

• You must protect customer data and use it only for fulfilling orders.
• You agree to our Merchant Privacy Policy.

7. Suspension or Termination

• We may suspend your store for poor performance, misconduct, false information, or legal issues.
• You may request account closure with written notice.

8. Limitation of Liability

Chibaobao is not responsible for losses caused by technical failures, force majeure, or third-party issues. Merchants are solely responsible for food quality and compliance with laws.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the platform means you accept the latest version.

10. Governing Law

These Terms are governed by Malaysian law. Disputes will be handled in the courts of Penang.
